Balking at Certificate of Insurance

Hey all, curious to know your opinions on this section I have come across in a deal memo issued by a reputable production company:

 

"Box Kit and Rentals

 

An inventory listing of box rental contents must be submitted to accounting. Be advised that (the production company) states that all insurance for loss and damage of box items is inclusive of box rental fees and are not covered by (the production company)"

 

 

I'm not the best at interpreting legal jargon, but this seems like they are trying to waive any responsibility and not willing to provide a COI.

Have any of you come across anything like this before?

Your kit Is not a box rental. Box rental items are items that individuals bring to set that are under their sole control. Things like ads laptops etc. your kit is camera gear that is under the use and control of many hence the need for a coi

 

 

Thank you Eric, I agree. It was the wording of "Box kit AND rentals" which caught my eye....which made me think they might be trying to slide in the Rentals part to be inclusive of their waiver. They are providing a COI.

Production will do waivers of "those rules" for the Steadicam & Sound Mixer for the reasons Eric said. Just ask.

 

 

YES!!! What Eric and Alec said:

Steadicam is simply NOT A BOX RENTAL. This distinction is an important one.
