Other guy has admitted fault so his insurance should cover everything. So now we have to figure out payment for lost wages. I was on a show but it ends mid January and then it was back to day playing. Has anybody else (unfortunatley) been in this situation? Is contacting a lawyer neccesary? I don't know how long I'm going to be down for, seeing the surgeons on tues. Now if I could just find a show where all I had to do was sit on the dolly and pan. Any advice is appreciated. Premium Members Dan Coplan Posted December 24, 2006 Premium Members Report Share Posted December 24, 2006 Nick, Just chiming in here - definitely seek more advice, but I was in a car wreck a few years ago where it was the other fuc..., pardon the French, the other guy's fault. With a history of invoices I estimated how much work/money I lost and it all worked out fine with the insurance company. I did my best to play it cool and avoid lawyers because in my opinion, that just gets messy and potentially costly (your time, how much goes to the lawyer vs. to you, etc.). My best friend used to be in the claims business and those guys get dumped on all the time so if you act reasonably, the claims agent will be more likely to work with you and get you what you want. You have plenty of time to resolve this so if you don't get what you want, you can always go the lawyer route. I maxed out the other guy's policy and had to resolve the claim with underinsured motorist coverage through my insurance company. They only gave me a fraction of what I was expecting so I then gave a pre-mediation/arbitration deposition which led to an acceptable settlement. If I didn't want to accept their offer, I would simply take it to the next step. Took a bit of time, but it was relatively painless and resolved it all without lawyers. Keep notes on EVERYTHING. I have a folder full of receipts from doctor appointments and a log noting doctor visits and updates on my condition. Good luck! Hope you're back flying soon! Sorry to hear this Nick. I had some shoulder surgery about 4 years ago and it put me out for a few months, so I know what you?re feeling. I have 2 pieces of advice to offer you, 1. You must get a lawyer. 2. Don?t go back before your ready; it will set you back even further. Take the advice of a really good physical therapist, your PT is everything with a shoulder injury.
