it was decemper 2003 when i decide to invest in a new monitor

after some emails and some phones with the manufactor we end in a deal .

the problem it was that i had never see the monitor ,so the manufactor tell me that i pay the monitor and if i dont want it i send it back and he send me the money ,except shipping off cource.so the monitor arrived in january 2004(its only a wrong and come with car and no with airplane)and it doesnt work after some phones courier take it back and bring me a new one in three days (with airplane no mistakes now)with no charge(the first possitive)finaly i was no happy with the monitor i send it back and i talk a lot with manufactor for any change (if he want to make in the future )about the monitor.THE PROBLEM IS THAT UNTILL TODAY HE HAVE NOT SEND ME MY MONEY BACK and he always try to tell me some excuses like "o i have to many work for the nab i prepare the new model ......

i will make the tranfer in the end off the week "or "i make the transfer but something happen with your bank...."i ask for him the bank receipt but he never fax it to me

so any suggestions ?

Is this a well known manufacturer? You don´t have to mention the name right away, but you might mention him that you will ask your colleagues in the Steadicam forum if there are more problems.

He might solve the issue then if he doesn´t want other potential customers to know about the monitor and financial problems.

Screw being politically correct.

Send him an email (polite) in a demanding sort of way. Stating, "you have one week to refund my money back in full or I will pursue other avenues in collecting."

 

Then be sure to post his name and company ALL over this site as a business NOT to do business with.

 

We have WAY too many scam artists in this world. Even more so now that it's a WORLD economy. If you can possibly do so, ALWAYS get recommendations before doing business with anybody.

 

We need to start a section of this forum that lists bad production companies, bad equipment companies, and bad business people.

We'd only be trying to protect ourselves and it would surely RAISE the bar on customer service for our industry.

I've always wanted to have this. Either on this forum or on a seperate web page.

I wonder what the legalities are of creating a web site that has a list of offending companies, producers and the like?

 

Geocities.com has free web space. I would do it but I already have my hands full with 2 web sites.. ug.

 

If anyone wants to create it, this is my contribution..

Owes me $4,259.03

Owes the rest of the crew money.

Owes the rental house money.

Owes Investors money.

 

I have proof of this claim:

Copies of Invoices, Dates scheduled and worked.

Detailed invoice from my lawyer about phone calls and letters made to Mr. Yapp.

Letters from Yapp himself saying how sorry he was for the "Delay" etc...

 

Still venting after 5 years....

I dropped the suit temporarely in order to get the paperwork for my days for the union. That show represented 81 days that were submitted. I told Yapp that I would drop the lawsuit... "for now," if he gave me the info that I needed ASAP but emphasized that I wasn't forgiving the debt.

 

A few weeks ago I talked to the lighting director from the show, who is also a friend of mine. He told me that one of the major investors filed a lawsuit against Yapp just recently and apparently Bob lost big time and had to claim PERSONAL bankruptcy he couldn't hide behind his company. I suspect it's because the investors found that he "may" have used the shows money to fix his own HUGE 3 story house in Iowa, yes his house was featured in the show. Nice huh?

 

I'll more than likely never see the money. I could file for $4,000 in small claims but I'd have to fly back to Iowa and then what.. perhaps put a lean on his house?

I paid a lawyer close to $600 to send Yapp letters and threaten him by phone.

My lawyer told me that Yapp said to her, "I had to sell my stove to feed my children."

 

If they ever show "About Your House" on PBS or anywhere else.... someone's going to pay. I believe it's a copyright infringement since I shot the show and have not been paid for it. I hope it airs.. oooh, I hope it airs.

 

Oh, and no crew member has been fully paid nor has the rental house(as far as I know).

Having to do that to get your paperwork must have made your blood boil! Well, at least you got it and you're on to bigger and better PAYING jobs.
